1. The promoter is Auto & General Services Pty Ltd ABN 61 003 617 909, AFSL 241 411 (trading as Budget Direct) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong 4066, Telephone: (07) 3377 8801 (Promoter) on behalf of the insurer, Auto & General Insurance Company Ltd (ABN 42 111 586 353) (Insurer).

  3. Information on how to qualify forms part of these Terms and Conditions (Terms). Customers who take up the offer are deemed to accept these Terms. If there is any conflict between these Terms and any other published material, these Terms prevail.

  4. Subject to these Terms the Promoter is offering its customers who hold a current: comprehensive car, home and contents, or roadside assistance policy (Eligible Policy) with the Promoter (Policy Holder) a $50 Digital Store Card DSC) for them and their friend/family member (Buddy) when the Policy Holder refers their Buddy to the Promoter and the Buddy takes out a Eligible Policy in accordance with clause 7 (Eligibility and Participation) below (Promotion).

  5. The Policy Holder will be issued with a Buddy code (Code) to participate in the Promotion. The Policy Holder will locate their Code on their Eligible Policy or Eligible Policy renewal documents.

  6. The Promotion commences at 12:01am on 11/01/2017 and ends at 11:59pm on 31/06//2017 (Promotion Period). All times are in Australia Eastern Standard Time. Customers are ineligible to participate after the Promotion Period.

  7. Eligibility and Participation

  8. In order to be eligible for the DSC, during the Promotion Period the Policyholder and Buddy (collectively the Customer) must meet all of the following criteria (Eligible Participant):

    1. Be an Australian resident. Australian resident means a person who resides in Australia at the time of application and either holds Australian or New Zealand citizenship; or holds an Australian permanent residency visa; or has been in Australia continuously for six months or more on a temporary work visa and currently resides in Australia;

    2. Purchase an Eligible Policy (with the Buddy quoting the Code);

    3. the Eligible Policy must be active and valid for a continuous period of not less than 21 days from the date the policy is issued (Cooling Off Period);

    4. purchase the Eligible Policy during the Promotion Period;

    5. The Buddy must not reside at the same address as the Policyholder and must not hold, or have previously held, any policies with the Promoter;

    6. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter.

  9. Privacy

The Promoter is committed to protecting your personal information and agrees to be bound by the Privacy Act 1988 (Cth).The Promoter’s privacy policy is available on the website www.budgetdirect.com.au and further details of how the Promoter will collect, store, use and disclose personal information can be found there.

  11. Personal information is collected in connection with entry into this Promotion for the purpose of facilitating access to the DSC. If the personal information requested is not provided, then a person will be ineligible to participate in this Promotion. By entering into the Promotion, the Customer consents to the Promoter disclosing the personal information to the DSC supplier, and to any of the Promoter’s related entities, using the personal information to process and validate the Customer’s claim for the DSC, and to arrange delivery to the Customer (if eligible).

  12. General

  13. Only one DSC will be issued to the Customer Eligible Policy.

  14. The Customer must only issue the Code to people they personally know.

  15. The Code is valid for 21 days from the date the Eligible Policy is purchased or until the expiry of the Promotion Period, whichever is earlier.

  16. The Customer will receive instructions to their nominated email address on how to redeem their DSC within 25 days of the expiry of the Buddy’s Cooling Off Period.

  17. The Customers will receive an email notification from the Promoter when the Code has been successfully applied and they are eligible for a DSC.

  18. Access to and use of the DSC is subject to any terms of use or rules issued by the DSC supplier. The DSC is not reloadable, refundable, transferable or exchangeable and cannot be taken as cash. If a DSC or receipt of it incurs a tax liability, the relevant recipient of the DSC is liable for payment of such tax.

  19. The DSC is issued by Digital Glue. Digital Glue’s term and conditions apply to the DSC and Eligible Participants agreed to be bound by those additional terms and conditions. The Promoter is not responsible for, or liable in respect of, products and services provided by Digital Glue.

  20. This Promotion is not available in conjunction with any other promotion or offer, and the Promoter reserves the right to disqualify any person from receiving the DSC:

    1. If it suspects fraudulent activity; or

    2. for a breach of these Terms; or

    3. if it decides the person has not acted in good faith; or

    4. for any false or misleading conduct of any kind.

  21. The Promoter reserves the right in its sole discretion or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at anytime without notice.

  22. The Promoter reserves the right to request that an Eligible Participant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate) within the Cooling off Period. If the Customer fails to do so, or the Promoter determines the policy does not meet the eligibility criteria of the offer, the Customer will not be eligible for the DSC.

  23. The Promoter, (including its officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the DSC (whether negligent or not), except for any liability that cannot be excluded by law.

  24. If the offer of the DSC is withdrawn or the Promotion terminated by the Promoter the Customer will only eligible for the DSC after the withdrawal or termination date if the offer was applied to the Customers policy while the offer was still in market.

  25. The Promoter reserves the right to substitute the DSC with another incentive of the same value.

  26. These Terms may be varied at any time without notice.

  27. The offer of the DSC and any offer of Budget Direct Insurance is subject to the Insurer deeming the risk is acceptable in accordance with its underwriting acceptance criteria.
