Full Terms and Conditions

1. Instructions on how to make a Budget Direct Price Beat Guarantee claim and the offer form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Guarantee is not valid in conjunction with any other offer.
   
   
2. Budget Direct Price Beat Guarantee claims are only open to Australian residents aged 25 years and over who purchase an applicable comprehensive car insurance policy (Policy) from Budget Direct. Employees (and their immediate families) of the Promoter and agencies associated with this offer are also ineligible to make a Budget Direct Price Beat Guarantee claim.
   
   
3. Claimants must be within the Promoter's trading terms throughout the promotional period and must not have overdue monies owing in order to be eligible to claim any reward.
   
   
4. Offer available for a Budget Direct Policy taken out (the day upon which the purchase was made) between 10.00am AEDST on 24 September 2006 and 11:59pm AEDST on 31st December 2008. Budget Direct Price Beat Guarantee claims close twenty one (21) days from date on which the Policy is taken out.
   
   
5. Offer only available on a Budget Direct Policy where drivers under 25 years of age are excluded.
   
   
6. To make a Budget Direct Price Beat Guarantee claim, claimants must obtain a car insurance quote from a competitor of Budget Direct for a lower price than the price paid for what is deemed a comparable policy quote (Quote) by the rules of comparison to their Budget Direct Policy. If this Quote is accepted by the Promoter as comparable the claimant will receive a refund for: a) the difference between the Policy and the Quote and b) $10, both will be in the form of a credit to their Budget Direct policy or bank account.
   
   
7. The rules of comparison are as follows:
   1. The Quote must be a bona fide full written quote for a substantially similar cover from an Australian insurer authorised by APRA, showing details of the vehicle, drivers and the insurance cover;
   2. It must show that the cover is comprehensive, at market or agreed value, for the same vehicle, kept at same address. If competitor quote is for agreed value it must be within 5% of the Budget Direct agreed value;
   3. It must show that the No Claim Bonus (Rating Number) specified is the same, and the Basic Excess similar (less than $50 difference).
   
   
8. To make a Budget Direct Price Beat Guarantee claim the Budget Direct customer must call (1300) 306 560 and notify the Customer Services Operator of their intention to claim the guarantee. They will be requested to fax a copy of the written quote through to fax (07) 3377 8855. The Quote will be assessed against the rules of comparison and a judgement made.
   
   
9. Claimant must provide genuine, reliable evidence of the Quote, to the Promoter within 21 days of the date of original insurance Policy purchase for verification purposes. Failure to provide sufficient evidence of a valid Quote may, in the absolute discretion of the Promoter result in invalidation of all of that claimant's claims. Evidence considered sufficient is at the discretion of the Promoter.
   
   
10. The Promoter reserves the right, at any time, to verify the validity of Budget Direct Price Beat Guarantee claims and claimants (including a claimant's identity, age and place of residence) and to disqualify any claimant who submits a Budget Direct Price Beat Guarantee claim that is not in accordance with these Terms and Conditions or who tampers with the Budget Direct Price Beat Guarantee claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    
    
11. Incomplete, indecipherable, or illegible Budget Direct Price Beat Guarantee claims will be deemed invalid.
    
    
12. Multiple Budget Direct Price Beat Guarantee claims permitted, subject to the following: (a) only one Budget Direct Price Beat Guarantee claim permitted per specified purchase requirement; and (b) each Budget Direct Price Beat Guarantee claim must be submitted separately and in accordance with Budget Direct Price Beat Guarantee claim requirements.
    
    
13. Claimants guilty of insurance fraud or failure to disclose all relevant insurance information at the time of applying for a Budget Direct policy or when making a Budget Direct Price Beat Guarantee claim are also ineligible.
    
    
14. Offer is not transferable or exchangeable and can only be taken as specified.
    
    
15. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any claimant and/or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
    
    
16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any Budget Direct Price Beat Guarantee claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; and/or (f) use of the offer.
    
    
17. The Promoter collects personal information in order to conduct the Offer. A Budget Direct Price Beat Guarantee claim is conditional on providing this information.
